WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SKYLARQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, OR DATA, EXCEPT WHERE APPLICABLE BY LAW.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Skylarq from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Any claim that your content caused damage to a third party

We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms.

You can terminate your account by contacting our support team. Upon termination, your right to use the Service will cease immediately.

All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class action.

These Terms constitute the entire agreement between you and Skylarq regarding the use of the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision will not be considered a waiver of such right or provision.

You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
